Criminal Record Availability
There are two primary ways to obtain criminal records:
1) Direct jurisdictional (County, Burroughs or Parrish) courthouse criminal records
ResidentCheck can provide either direct courthouse records from any jurisdiction nationwide
or database criminal records. We prefer you understand the differences to select the criminal check that best meets your timeliness and budgetary needs.
Jurisdictional Records
Criminal records originate and are updated by the courts at the jurisdictional level. Only by obtaining information directly from jurisdictional courthouses will you have real time current
and complete criminal information.
Database Records
Database records do not provide current criminal activity. These records are processed for reselling and then updated infrequently, often monthly, quarterly, or even annually. Some jurisdictions never report at all.
Criminal databases are also not updated to reflect dismissed status, cases not prosecuted or
if the applicant has successfully served deferred adjudication. This results in “false positive” reports that will deny otherwise qualified applicants.
Additionally, “false negative” reports can result from CPU's missing criminal records that only trained professionals will identify. ResidentCheck helps validate alias names, name variations and missing or incomplete identifiers such as dates of birth.
Some screening companies use marketing claims listing an excessive number of database records being checked. However, if the records are not current and accurate, checking databases without validation is of questionable value.

Criminal Record Validation
The same criminal offense can be classified by a different name with varying sentencing
guidelines by jurisdiction and by State. Having a licensed professional to review these
records, ResidentCheck ensures we match the proper criminal records with your applicant
by interpreting and validating jurisdictional and sentencing codes to assure compliance with your approval standards.
With the limitations of a CPU-to-CPU database criminal record search alone, both “false positive” and “false negative” reports will occur. Validation of criminal records for accuracy also helps assure compliance with Fair Credit Reporting Act and Fair Housing guidelines.
